Appellant,

                                                                             v.

                                       GENERAL SERVICES ADMINISTRATION,

Respondent.

John Cook, Vice President of Asset Management, Texas, Younan Properties, Inc., Dallas, TX, appearing for Appellant.

Mel E. Myers, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent.

DANIELS, Board Judge (Chairman).

                                                                       ORDER

Younan Properties, Inc. (Younan) asked the Board to direct the General Services Administration to pay invoices in the amount of $38,390.53 which Younan had submitted under a contract for the lease of space in a building in Houston, Texas.  Younan explained that it had asked the contracting officer to make payment and that she had refused to do so.

At a preliminary telephonic conference, Younan acknowledged that it had not made a claim for the amount in dispute.  It said that it would file such a claim and, if not satisfied with the contracting officer=s decision on the claim, would appeal that decision to the Board.  Younan requested that the Board dismiss the pending case, recognizing that the case has not been properly placed before us.

This case is DISMISSED.
