ORDER

On May 11, 2009, Claro Communications Group, Inc. filed a notice of appeal in connection with a dispute under contract number 50-3142-5-0001, to perform certain physical security updates at sites in Leetown, West Virginia; Dubois, Idaho; and Pullman, Washington. On October 22, 2009, respondent filed a motion to dismiss, along with an executed settlement agreement. Appellant has no objection to the dismissal of this appeal.

Accordingly, this appeal is DISMISSED WITH PREJUDICE.
