     Appellant confirmed during a conference call on February 12, 2007 that its letter dated
February 9, 2007 was a request that this appeal be dismissed with prejudice.  The
Government does not object to such a dismissal.  This appeal, therefore, is DISMISSED
WITH PREJUDICE.
