On or about February 8, 2007, the respondent, Department of Veterans Affairs, and the appellant, New England Design Associates, Inc., in the above-referenced appeals filed a Joint Motion for Judgment on Stipulated Settlement. The motion enclosed the Stipulation of Settlement, executed on February 7, 2007, and February 8, 2007, and entered into by the parties concerning the above-referenced appeals. The parties recite that the issues which are the subject of these appeals have been resolved and jointly move that the Board enter judgment in favor of New England Design Associates, Inc. in the amount of $330,000, as follows: 1. Respondent agrees to pay Appellant in the amount of Three Hundred Thirty Thousand Dollars ($330,000.00), the payment to be made through award by the CBCA [Civilian Board of Contract Appeals] in these appeals. 2. This payment of $330,000.00, represents a complete accord and satisfaction of these appeals and includes all costs, both direct and indirect, including attorney fees and CDA [Contract Disputes Act] interest. Inasmuch as the parties have stipulated the equitable adjustment due New England Design Associates, Inc., their Joint Motion for Judgment on Stipulated Settlement is granted. The appeals are GRANTED IN PART. Appellant, New England Design Associates, Inc., is found entitled to the amount of $330,000, pursuant to the terms and conditions of the Stipulation of Settlement entered into by the parties. ________________________ PATRICIA J.
