ORDER On February 6, 2007, the parties advised the Board that they have settled the matters set forth below and jointly moved the Board to dismiss the appeals with prejudice. Pursuant to the agreement of the parties, and in accordance with the settlement agreement entered into between the parties, the appeals of Innovative (PBX) Telephone Service, CBCA 6, 36, 37, 38, 39, 40, 41, 42, and 43, are hereby DISMISSED WITHOUT PREJUDICE. This dismissal shall convert to one with prejudice ninety days from the date of this order or upon effectuation of the settlement agreement, whichever occurs first.
