ORDER
On
April 4, 2005, Rural Community Insurance Services (insurance company) filed a
notice of appeal and complaint seeking review of the determination made by the
Deputy Administrator for Compliance of the Risk Management Agency (RMA) that
the insurance company was liable for an indemnity overpayment of $142,443 and a
premium overstatement of $17,919.
Arising under a Standard Reinsurance Agreement (SRA), the dispute
concerns alleged actions and inactions of the insurance company relating to the
policy of Amerjit Bhatti for prunes in crop year 1999. The matter was timely filed, and is now
before this Board. 72 Fed. Reg.
31,437-38 (June 7, 2007).
At
the request of the parties, formal proceedings were suspended while matters
involving the underlying policy holder were resolved. On June 10, 2008, the Board received from the
parties a joint stipulation requesting a dismissal with prejudice of this
matter.
The
case is DISMISSED WITH PREJUDICE.
